This presentation will focus on issues a lender should consider when dealing with a distressed secured loan and considering whether to foreclose on collateral, restructure the loan, negotiate a transfer in lieu of foreclosure, or sue on a guaranty. The specific focus of this presentation will be evaluating the risks and benefits of taking ownership of real estate in various stages, from raw land, property under development, to stabilized assets. Adam Sher, a partner in HRO's Real Estate Practice Group, will discuss various legal considerations facing lenders in these situations and Teresa Kerrigan, President of Raw Land Solutions LLC, will discuss the unique due diligence that is necessary when considering taking ownership of these properties and projects.
