Fraudster Loses Bid to Unfreeze Assets to Pay SEC Defense Attorney

Securities fraud convict Thomas Rittweger, appearing pro se from the federal prison where he is incarcerated, failed March 8 to persuade the U.S. District Court for the Southern District of New York to unfreeze assets in a related 10-year old Securities and Exchange Commission civil enforcement action so that he has the funds to hire an attorney to defend him in the SEC lawsuit (SEC v. Credit Bancorp Ltd., S.D.N.Y., 99 Civ. 11395, 3/8/10).  Click here to view a PDF of the full article

HRO partner Michael MacPhail was quoted in the 01/25/2010 edition of Securities Regulations & Law Report in regard to his comments on the 2010 Outlook: SEC Enforcement. The article, “2010 Important for SEC Enforcers as Division Continues to Rebuild Reputation” written by Yin Wilczek and Phyllis Diamond comments on the SEC's Enforcement Division beginning 2010 on a good note, announcing the start up of the national specialized units and cooperation initiatives for individuals and companies. In his article entitled "Smoking Gun," Scott discusses the significance of a recent California appellate court ruling that determined that the owner/manager of an apartment complex could be liable under a public nuisance cause of action for personal injuries suffered by a tenant where the property owner/manager permitted smoking in outdoor common areas (pools, picnic and other areas) of the apartment complex.
