Experience
Jesse Markham is Co-Chair of HRO’s Antitrust and Competition Group and a counseler in the Litigation Practice Group. His practice focuses on antitrust litigation and counseling with an emphasis on class action defense, antitrust agency practice, mergers and acquisitions, and criminal defense. He is a recognized authority on antitrust law and represents clients before enforcement agencies on civil and criminal investigations and proceedings. Internationally, he participated in the effort to establish antitrust enforcement mechanisms for Russia and the Ukraine and has represented clients in international criminal cartel investigations. He is a leading expert on China’s Anti-Monopoly Law, and has spoken by invitation at the Ambassador’s Roundtable in Beijing as well as a conference of China’s new antitrust agencies.
Mr. Markham has special industry experience in health care, telecommunications, technology, forest products, energy, banking and finance, airlines, and agriculture. A sample of representative engagements includes:
- Representing health care finance company in connection with a proposed merger
- Representing medical group in connection with Federal Trade Commission inquiry
- Counseling medical groups and health care finance companies
- Lead counsel for paper company in complex multidistrict and state antitrust class actions
- Overseeing petroleum divestitures under a federal consent decree
- Counseling a leading producer of polyethylene and other materials
- Counseling a leading bicycle producer
- Representing a major U.S. bank in antitrust litigation challenging interchange fees
- Representing airlines in connection with proposed merger
- Representing Japanese airline in U.S. antitrust litigation
- Representing leading participant in cellular telecommunications markets
- Representing leading Japanese telecommunications companies in U.S. antitrust litigation
- Participation in numerous standard-setting initiatives
Before joining HRO, Mr. Markham served as the Chair of Morrison & Foerster’s Antitrust practice and as Deputy Attorney General for California and Massachusetts. He is the Marshall Madison Professor of Law at the University of San Francisco Law School, where he teaches antitrust law among other courses. He has also served on the faculties of the intensive Advocacy Training Institutes at USF and at Stanford Law School, and has lectured as a guest speaker at the Haas Business School and at Boalt Hall. He has published many articles and co-authored several books on antitrust law. Mr. Markham has frequently been included in leading antitrust lawyer directories including Chambers USA Leading Antitrust Lawyers, The Best Lawyers in America, Marquis Who’s Who in American Law, Northern California Super Lawyers.
